Terms of Use
These terms set the general rules for using BlackwireSoftware.com and Blackwire software, subject to any product-specific license terms that also apply.
1. Agreement to these terms
These Terms of Use apply to BlackwireSoftware.com and to Blackwire software except where a separate product license agreement, end-user license agreement, purchase term, support-contribution disclosure, or other written agreement applies. By using this website or Blackwire software, you agree to follow the terms that apply to that use.
2. Company and ownership
BlackwireSoftware.com, the Blackwire Software brand, Blackwire product names, website content, software, documentation, graphics, and related materials are owned by or licensed to Blackwire Software LLC and are protected by applicable intellectual-property laws.
3. Website use
You may use this website for lawful informational, support, and purchasing-related purposes. You may not attempt to interfere with the website, misuse its services, impersonate another person or organization, probe or bypass security controls, or use the website for unlawful activity.
4. Licensed products and products distributed without paid license activation
Blackwire may distribute products under different models. Products identified as licensed products are licensed, not sold, and the rights granted to a user depend on the applicable product, edition, and license terms.
Blackwire may also distribute certain products without a paid Blackwire license key or activation requirement. A product page will identify when the current release uses this model. Software distributed without paid license activation remains the intellectual property of Blackwire Software LLC and may still be subject to product-specific use, redistribution, commercial-use, safety, and other terms.
5. Support contributions for products without paid license activation
When Blackwire offers a paid Support, Supporter, Business, or similar option for a product expressly distributed without paid license activation, the payment is treated as a product-support contribution intended to help fund continued development, compatibility testing, documentation, maintenance, and growth of that product. It is not the purchase price of a Blackwire software license.
The applicable product page may provide a particular download, boot-media option, reporting-enabled build, or other supporter benefit. A support contribution does not transfer ownership of the software and does not create a guarantee of future versions, features, compatibility, continued availability, or support unless Blackwire expressly states otherwise.
Product-support contributions are final and non-refundable except where a refund is required by applicable law or is processed or required under the rules, legal obligations, or discretion of the payment provider or Merchant of Record.
These support contributions are not charitable contributions and are not represented by Blackwire Software LLC as tax-deductible donations.
6. Software restrictions
Except where applicable law or an applicable product term expressly permits it, you may not unlawfully copy, redistribute, resell, sublicense, modify, reverse engineer, decompile, bypass licensing or technical controls, remove ownership notices, or use Blackwire software in a way that violates the rights of Blackwire Software LLC or others.
Tools that can erase data, modify systems, install drivers, migrate information, or perform other consequential operations must be used only on systems, devices, accounts, and data you own or are authorized to service. You are responsible for confirming authorization and maintaining appropriate backups before performing consequential work.
7. Product information, availability, pricing, and supporter options
Blackwire makes reasonable efforts to describe products accurately. Features, requirements, editions, supporter options, pricing, availability, release timing, licensing status, and supported hardware or software may change. A product marked Coming Soon or preparing for public release is not represented as currently available for purchase or download.
Where a product is offered under a support-contribution model, the product page will identify that status and describe the purpose of the contribution. Where a product is licensed, the applicable license terms and activation requirements will apply.
8. Third-party services
Blackwire may use or link to third-party services for website hosting, form processing, spam protection, email delivery, payment processing, license management, downloads, or support. Website forms are processed through Blackwire-controlled Cloudflare services, including Workers, Turnstile, Email Service, and D1 where applicable. Paid transactions and affiliate tracking or payouts may be processed through Sold through Link, LLC f/k/a Lemon Squeezy LLC ("Lemon Squeezy") or another payment provider or Merchant of Record. Use of third-party services may also be subject to those providers' terms and policies.
9. Refund policy
Refund eligibility depends on the type of transaction. Licensed software purchases may be eligible for review under Blackwire's published Refund Policy. Product-support contributions for products distributed without paid license activation are non-refundable under Blackwire's policy except where applicable law or the payment provider or Merchant of Record requires or processes a refund.

10. No universal compatibility or diagnostic guarantee
Computer hardware, firmware, operating systems, drivers, storage devices, security settings, and third-party software vary widely. Blackwire does not guarantee that every product will work with every configuration or that diagnostic software will detect every possible fault. Product pages and documentation may identify specific limitations, safety requirements, and supported environments.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the website, software, documentation, and related services are provided on an "as is" and "as available" basis without warranties not expressly provided in a separate written agreement. Nothing in these terms excludes warranties or consumer rights that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Blackwire Software LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website or software, including lost data, lost profits, business interruption, or loss of goodwill, except where such limitation is prohibited by law.
Users are responsible for maintaining appropriate backups, reviewing warnings, confirming device or system identity, and following product documentation before performing destructive, repair, migration, firmware-related, or other consequential operations.
13. Changes to these terms
Blackwire may update these Terms of Use as products, services, licensing, supporter models, payment providers, or legal requirements change. Updated terms become effective when published unless a different effective date is stated.
14. Governing law
These terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles, except to the extent that applicable consumer or other mandatory law requires otherwise.
